Copmanthorpe Neighbourhood Plan
1. Summary
Following a positive referendum result on the 27th November 2025, City of
York Council is publicising its decision made by the Director of City
Development on 3 December 2025 to ‘make’ the Copmanthorpe
Neighbourhood Plan part of the City of York Development Plan in accordance
with Regulation 19 of the Neighbourhood Planning (General) Regulations
2012.
2. Background
Copmanthorpe Parish Council, as the qualifying body, successfully applied for
the Parish of Copmanthorpe to be designated as the Copmanthorpe
Neighbourhood Area under the Neighbourhood Planning (General)
Regulations (2012). Following the submission of the Copmanthorpe
Neighbourhood Plan to the Council, the plan was publicised and comments
were invited from the public and stakeholders. The consultation period closed
on 14th May 2025.
3. Decision and Reasoning
A referendum on the Neighbourhood Plan was held on Thursday 27th
November 2025 and 95.3% of those who voted were in favour of the
Neighbourhood Plan. Paragraph 38A (4)(a) of the Planning and Compulsory
Purchase Act 2004 as amended requires that the Council must ‘make’ the
Neighbourhood Plan if more than half of those voting have voted in favour of
the plan. City of York Council is not subject to this duty if the making of the
Neighbourhood Plan would breach, or would otherwise be incompatible with,
any retained EU obligation or any of the Convention rights (within the meaning
of the Human Rights Act 1998).
The referendum held on 27th November 2025 met the requirements of the
Localism Act 2011; it was held in the Copmanthorpe Neighbourhood Area and
posed the question:
Do you want City of York Council to use the Neighbourhood Plan for
Copmanthorpe to help it decide planning applications in the
neighbourhood area?
The count took place on 27th November 2025 and greater than 50% of those
who voted were in favour of the Neighbourhood Plan being used to help
decide planning applications in the plan area.
The results of the referendum were:

The Council considers that the Copmanthorpe Neighbourhood Plan meets the
basic conditions (set out in paragraph 8(2) of Schedule 4B of the Town and
Country Planning Act 1990 as amended), its promotion process was compliant
with legal and procedural requirements and it does not breach the legislation
(set out in Section 38A(6) of the Planning and Compulsory Purchase Act
2004).
Double Yellow line proposals for the village
Parking in the village continues to be a major concern, particularly on Main Street and other busy roads in the village centre. We have raised this matter with City of York Council, in an attempt to find potential solutions. Despite our considerable protestations, we have been informed that bollards cannot be installed opposite the Royal Oak, due to issues with nearby utilities. We are very disappointed with this outcome, but it seems we have no option but to accept their proposal for double yellow lines. At best, this might deter parking (though as we know, the lines recently re-instated by the Co-op do are of limited benefit). Double yellow lines will only be truly effective if penalties are enforced by regular patrols, which is unlikely.
Without specific consultation, City of York Council has informed us of the NOTICE OF PROPOSALS TO THE YQRK PARKING STOPPING AND WAITING AMENDMENT which covers numerous parking restrictions that they will be introducing alongside many others across the City.
